Terms and Conditions 

1. Definitions

1.1. Client: The person or organisation booking the services of the Photographer.

1.2. Photographer: Patrick Bannon/Patrick Bannon Photography, providing photography services as per this agreement.

1.3. Services: The photography services provided by the Photographer as detailed in the Booking Confirmation.

2. Booking and Payments

2.1. Booking Confirmation: A booking is considered confirmed upon receipt of a signed contract and the non-refundable booking fee/deposit.

2.2. Booking Fee: A non-refundable deposit of an agreed amount is required to secure the date. This fee will be applied to the total cost of the services.

2.3. Payment Terms: The remaining balance is due 1 week after the event. Payments can be made as per invoice, via BACS and where appropriate, card payment. 

3. Cancellation and Refunds

3.1. Cancellation by Client: The Client may cancel the booking by giving written notice to the Photographer. The booking fee is non-refundable. If the cancellation occurs less than 10 days before the event, 75% of the total cost will be due.

3.2. Cancellation by Photographer: In the unlikely event that the Photographer cancels the booking, all fees paid by the Client will be refunded in full.

4. Rescheduling

4.1. Rescheduling by Client: Any rescheduling must be agreed upon in writing. The Photographer will try to accommodate the new date but cannot guarantee availability. An additional fee may apply.

4.2. Force Majeure: The Photographer is not liable for any failure to provide services due to events beyond their control, such as natural disasters, illness, or other emergencies. The photographer will use all means available to provide cover in the event of such a scenario. 

5. Photographic Materials

5.1. Delivery of Photos: The final images will typically be delivered within one week (maximum of two weeks during extremely busy periods) of the event. The delivery method will be online gallery and file transfer. Other means can be agreed upon at the time of booking should the client require it. 

5.2. Image Editing: The Photographer will perform full post-processing/editing to a high standard. 

5.3. Raw Files: Raw files (the unedited digital negatives) remain the property of the Photographer. 

6. Usage Rights

6.1. Client Usage: The Client is granted a non-exclusive license to use the final images for personal use. This includes printing and sharing on social media with proper credit to the Photographer.

6.2. Photographer Usage: The Photographer reserves the right to use the images for portfolio, advertising, marketing, and promotional purposes.

6.3. Commercial Use: Any commercial use of the images by the Client must be negotiated and agreed upon in writing, with additional fees applicable.

7. Liability

7.1. Limitation of Liability: The Photographer’s liability for any claim, loss, or injury is limited to that covered by the photographers Public liability insurance (£3,000,000) A certificate can be produced on request

8. General Provisions

8.1. Governing Law: This agreement shall be governed by the laws of The United Kingdom.

8.2. Entire Agreement: This agreement constitutes the entire agreement between the Client and the Photographer and supersedes all prior agreements.

8.3. Amendments: Any amendments to this agreement must be made in writing and signed by both parties.

9. Acceptance

By booking services with the Photographer, the Client agrees to these Terms and Conditions.
